Terms of Service

These Terms govern your use of ByRequest ("ByRequest," "we," "us," or "our"). By creating an account, using a board, or otherwise using the Services, you agree to them. If you do not agree, do not use the Services.
1. The Services
ByRequest is a feedback board. Teams create a workspace, collect feature requests from the people who use their products, and triage those requests — from the web admin, or from a coding agent over our MCP server. The people who contribute to a board can file requests, vote, comment, and subscribe to updates.
We may change, add, or remove features. Where a change materially reduces functionality you rely on, we will make reasonable efforts to tell you in advance.
2. Eligibility and Accounts
You must be at least 16 years old to create an account. You are responsible for the accuracy of your account details, for keeping your credentials secure, and for everything done under your account.
Signing in to a board is done with a single-use link sent to your email address. Anyone with access to that mailbox can sign in to that board, so keep it secure.
Tell us promptly at support@byrequest.app if you believe your account has been used without your authorisation.
3. Your Workspace and Your Content
"Your Content" means everything you or your Contributors put into your workspace: requests, comments, votes, board names, tags, settings, uploaded files, and imported lists.
You retain all rights to Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and transmit it strictly as needed to provide the Services to you — and no further. We do not sell it, and we do not use it to train models.
You are responsible for Your Content, including whether you have the right to put it into the Services.
4. Your Responsibilities as a Team
If you run a board, you are the data controller for the personal data on it, and we process it for you. That has real obligations, and they are yours:
- Imports. You may import names and email addresses. You must have a lawful basis for doing so, and you must not import people who have asked you not to contact them.
- Email. People on your board receive notifications about requests they are involved in. You must not use the Services to send marketing, newsletters, or bulk mail unrelated to the board.
- Your own email provider. If you connect one, you are responsible for that account, its reputation, and complying with its terms.
- What you collect. You decide what to ask your Contributors for. Do not collect sensitive categories of personal data — health, financial, biometric, or similar.
We process that personal data on your behalf and on your instructions, as described in our Privacy Policy.
5. Acceptable Use
You must not:
- Break the law, or infringe anyone's rights, using the Services
- Upload malware, or anything designed to disrupt or damage the Services
- Attempt to gain unauthorised access to any part of the Services, any account, or any other Team's workspace
- Probe, scan, or test the vulnerability of the Services without our written permission
- Use the Services to send unsolicited bulk email
- Impersonate anyone, or file requests using an email address that is not yours and that you have no permission to use
- Scrape or bulk-extract data from boards you do not run
- Place unreasonable load on the Services, or circumvent any limit we apply
- Resell or white-label the Services without our written agreement
We may suspend or terminate accounts that breach this section. Where a breach is serious — particularly one that risks other Users or our sending reputation — we may act immediately and without notice.
6. Guest Contributions and Public Boards
A Team may allow requests from people who are not signed in. Where that is enabled, anyone who can reach the board can file a request by providing a name and email address, and we do not verify that the address belongs to them before the request appears.
If you run a board, you are responsible for moderating what appears on it. If you contribute to one, remember that a public board may be visible to anyone with the link.
7. Subscriptions, Payment, and Billing
Some features may be offered on paid plans. Where they are, fees, billing periods, and inclusions are as described at the point of purchase. Unless stated otherwise, fees are exclusive of taxes, and subscriptions renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period.
If we change pricing, we will give you reasonable notice before it applies to your renewal.
8. Cancellation and Termination
You can stop using the Services at any time, and you can delete your account from your account settings.
We may suspend or terminate your access if you breach these Terms, if required by law, or if providing the Services to you becomes commercially or technically impractical. Except where a breach makes it inappropriate, we will give you reasonable notice and an opportunity to export Your Content.
On termination, your right to use the Services ends. We will delete or de-identify Your Content in accordance with our Privacy Policy, except where we are required to retain it.
9. Intellectual Property
The Services, including their software, design, and documentation, are owned by us and our licensors and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services, and nothing more.
Feedback you send us about the Services may be used without restriction or obligation to you.
10. Third-Party Services
The Services rely on third parties — hosting, email delivery, error monitoring — listed on our Sub-processors page. If you connect your own provider, your use of it is governed by that provider's terms, and we are not responsible for it.
11. Availability
We aim to keep the Services available and reliable, but we do not promise uninterrupted or error-free operation. We may need to suspend access for maintenance, and we will try to minimise disruption.
You are responsible for keeping your own copies of anything you cannot afford to lose. Teams can export their board's data at any time.
12. Privacy and Data Processing
Our Privacy Policy explains what we collect and why, and how we handle personal data we process on your behalf.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under applicable consumer law that cannot lawfully be excluded. Where such a guarantee applies and we are permitted to limit our liability, our liability is limited, at our option, to resupplying the Services or paying the cost of resupply.
15. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services.
To the maximum extent permitted by law, our total liability arising out of or in connection with these Terms or the Services is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred dollars.
16. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from Your Content, your use of the Services, or your breach of these Terms — including any claim brought by a person whose personal data you put into the Services.
17. Changes to These Terms
We may update these Terms. The updated version is indicated by the "Last Updated" date and takes effect when it is accessible. Where a change is material, we will make reasonable efforts to notify you. Continuing to use the Services after a change means you accept it.
18. General
These Terms are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
